1. Validity
These terms and conditions govern Party Partyculars Ltd including
www.partypartyculars.co.uk performance relating to the sale and supply of goods to the customer. We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you.

2. Contract with customer
A binding contract is created between Party Partyculars Ltd and the customer when the customer receives communication from Party Partyculars Ltd in writing confirming acceptance of their order.

The technical steps required to create the contract between you and us are as follows:
  1. You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process.You will be guided through the process of placing an order by a series of simple instructions on the Website.

  2. We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from Party Partyculars.

  3. When your product is despatched we will send you a despatch confirmation email.

  4. Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it.

 Party Partyculars refusal of an order may be a result of one of the following:

  •  The product you ordered being unavailable from stock.

  •  Our inability to obtain authorisation for your payment.

  •  The identification of a pricing or product description error.

  •  The identification of a typographical or arithmetical inaccuracy

 

3. Pricing and Availability
The prices of the goods are those specified on Party Partyculars Ltd Website. There will be an additional charge for delivery. Orders are subject to availability. In the unlikely event that the product(s) are unavailable, the customer will be notified by Email or telephone. Price and availability information is subject to change without notice.

4. Payment
Where the customer is using the online payment method, Party Partyculars Ltd uses a recognised online payment gateway that has secure server software encryption to keep your transaction private and protected. Paying by this method will require the buyer to visit another website. Party Partyculars Ltd accepts no responsibility and shall not be liable for errors or omissions on the part of the payment gateway that results in the disclosure of confidential information, loss, expense or damage howsoever arising to the buyer. It is the responsibility of the buyer to read the terms of business of the payment gateway before using the service.

5. Delivery of Goods
Party Partyculars Ltd will deliver the product(s) ordered to the delivery address supplied by the
customer. Availability permitting, all orders paid for by credit/debit card will be delivered within 3 to 5 working days. Orders paid for by cheque require an additional 5-7 working days for clearance of funds and are then dispatched in the same way. Party Partyculars Ltd is entitled to deliver in part. Dispatch of goods constitutes fulfillment of contract.

Party Partyculars will not be liable for delay or failure to deliver products promptly if such failure arises due to the force majeure or by reason of any delays occasioned by strikes, riots, lockouts, or other labour trouble, war, fire, accident, mechanical failure, non-availability of manufactured stock, part, or materials; delay or failure of delivery of the products to Party Partyculars by manufacturer's suppliers or other persons; government action, legislation or regulation of any kind; Act of God. Or any circumstances whatsoever outside our reasonable control.

6. Party Partyculars Ltd Warranty
If the product(s) delivered are not what the customer ordered, or are of incorrect quantity, or are damaged or defective, Party Partyculars Ltd will, if the customer returns them within a fourteen day period, at the customer's option either give a full refund or where possible make good any shortage or non-delivery or replace any damaged or defective product(s). The cost of returning faulty product(s) to us will be refunded.

7. Return of goods - 100% money back guarantee!
Party Partyculars want you to be 100% satisfied every time you shop with us.
Any product(s) purchased from Party Partyculars may be returned for any reason within 7 working days of receipt for a full refund (less the cost of delivery) or exchange. The cost of returning the product(s) to us shall be borne by you.

If you wish to return any product(s) please contact us by sending an email to customerservices@partypartyculars.co.uk or on 0845 652 2278  to let us know you will be doing so.

Before returning your goods please note the following:

7.1. You must ensure that the product(s) you return to us are in the brand new condition, with the same unopened packaging you received it in. You must include a copy of your invoice when you send the parcel back to us, as failure to do so may result in delay of any refund.

7.2. We regret that outbound shipping costs cannot be refunded. For exchanged product(s), you may be asked for a nominal fee as a contribution towards any additional postage of shipping depending on which shipping method you require.

7.3. We are sorry but we are unable to replace or exchange any product(s) until the original has been received by us. If you need any product(s) urgently, we would suggest you place a second order for the new product(s) and send the original back at a later date.

7.4. You are responsible for any returned product(s) until they reach us. We strongly recommend that you use a 'signed for' delivery method e.g. Recorded delivery, as Party Partyculars cannot be held responsible for product(s) lost in transit.

7.5. We aim to make refunds within 14 days of receipt of the goods, though promise to make refunds within 30 calendar days from receipt of goods. Please note that we will not be held liable for any interest payment that you may incur because any refund was made outside of your credit/debit card timescales.

7.6. All refunds will be made using the original payment method, and details.

8. Health and Safety (Toys and Balloons)
All of the toys on Party Partyculars website comply with the European Toy Safety Regulation CE mark and age guidelines where appropriate. Unless otherwise stated, toys are UNSUITABLE for children under 3 years old. An adult must supervise the use of any product at all times. The buyer is responsible for ensuring that all statutory government or local authority regulations are complied with in relation to the use of any products purchased from Party Partyculars Ltd.

Adults should always inflate balloons and supervise their use with children under 8 years old.

9. Service Access
While we try to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
